Adecuación y asimetría jurídica en la traducción de nombres de órganos judiciales del francés al español en documentos sobre derechos humanos de las Naciones Unidas

Abstract

In multilingual international organisations, univocity and legal security depend on the attainment of inter-and intralinguistic consistency and product adequacy to the brief’s macro-and microtextual priorities during translation. In these settings, the analysis of decisions made in the case of legal terminology-the most visible feature of legal discourse-can help to draw a picture of the state of translation. Building on the results of previous lexicometric studies that point to a potential link between the degree of legal asymmetry and consistency and adequacy levels, this paper focuses on the translation into Spanish of six terms designating jurisdictional bodies in French-speaking legal systems appearing in United Nations documents. Our aim is to determine if the renderings extracted from human rights monitoring procedures documents conform to microtextual priorities and whether the quantitative analysis of data disaggregated by year of publication and textual genre unveil trends worth commenting. The study is part of the second workstream of the LETRINT project.
