Le présent mémoire se donne pour objectif de s'intéresser à certains aspects de cette crise ainsi qu'aux réformes proposées pour y remédier. Dans un premier temps, sont examinées les difficultés ayant trait à la cohérence des décisions arbitrales, à la transparence, ainsi qu'au gel règlementaire. Le travail se poursuit par une analyse approfondie de trois propositions de réforme, soit la réforme des règlements de procédure du Centre international pour le règlement des différends relatifs aux investissements (CIRDI), la réforme du Groupe de travail III de la Commission des Nations unies pour le droit commercial international (CNUDCI), ainsi que la réforme émanant de l'Union européenne. Enfin, ce mémoire se conclut par une discussion portant sur l'axe de réforme le plus opportun. Despite a remarkable rise over the last twenty years, investor-state dispute settlement (ISDS) is currently in the throes of an acute crisis and is the subject of various criticisms from academia, civil society and the business sphere. This Master's thesis seeks to address some aspects of the crisis and the reforms proposed to overcome it. First, it examines the difficulties relating to the consistency of arbitration decisions, transparency and regulatory chill. The paper then proceeds to an in-depth analysis of three reform proposals, namely the reform of the procedural rules of the International Centre for Settlement of Investment Disputes (ICSID), the reform of Working Group III of the United Nations Commission on International Trade Law (UNCITRAL), and the reform by the European Union. Finally, it concludes with a discussion on the most appropriate axis of reform.
