Ce phénomène de « Brexatom » peut toutefois être contesté, car l'Euratom est une entité juridique séparée de l'Union européenne, fondée par un traité distinct. Cependant, l'article 106bis du Traité Euratom renvoie entre autres à l'article 50 TUE régissant la sortie de l'UE. Selon les différentes interprétations de l'article 106bis, on peut arriver à deux résultats : 1) la procédure de sortie de l'Euratom doit se faire de manière parallèle à celle de l'UE ou 2) une sortie de l'UE est possible tout en restant membre de l'Euratom. Il faut toujours garder en tête la volonté des citoyens et du gouvernement britanniques par rapport à ce sujet et les problèmes résultant d'une sortie partielle. Finalement, ce projet de recherche présente les relations entre le Royaume-Uni et l'Euratom après le Brexit et ses conséquences sur le système de garanties nucléaires. When Theresa May notified the exit of the UK from the EU, the exit from Euratom was regarded as automatically being part of it. This phenomenon called “Brexatom” is, nevertheless controversial because Euratom was founded by a distinct treaty and thus, is a separate legal entity from the EU. However, the article 106bis of the Euratom Treaty refers among others, to article 50 TEU regulating the exit procedure from the EU. Depending on the different interpretations of the article 106bis one can come to two conclusions: 1) The exit procedure from Euratom needs to be carried out in parallel to the exit from the EU or 2) an exit from the EU is possible without withdrawing from Euratom. It is important, however, to take into consideration what the British government and citizens want to achieve and the problems which can arise from a partial exit. Lastly, this bachelor thesis aims to present the possible relation between the United Kingdom and Euratom after the Brexit and its consequences on the nuclear safeguards system.
