International Court of Justice (ICJ). The Role of the International Court of Justice in Developing International/Global Law: a Survey of International Court of Justice Decisions, 2023–2024

Abstract

The period between 1 August 2023 and 31 July 2024 was marked by intense activity. Two judgments, one advisory opinion and nine orders on preliminary measures and the admissibility of a declaration of intervention were issued. The advisory opinion analysed the legality of Israel’s policies and practices in the occupied Palestinian territory. The judgments related to Ukraine and Russia (allegations of terrorism financing; allegations of genocide) shed light on the interpretation and application of the Convention on the Elimination of Racial Discrimination, as well as the Genocide Convention. Finding of the Court regarding these two Conventions give significant indications for pending and upcoming decisions (Gambia v. Myanmar; Armenia v. Azerbaijan; Azerbaijan v. Armenia; South Africa v. Israel; Nicaragua v. Germany).
