Abstract

The recognition of children as rights-bearing individuals has transformed global legal systems, yet the question remains: are the children truly heard in judicial proceedings? This thesis explores the effectiveness of the child’s right to be heard within the justice system in Benin, a right enshrined in international instruments such as the Convention on the Rights of the Child (CRC, 1989) and the African Charter on the Rights and Welfare of the Child (1990), and transposed into national law through the Code de l’enfant (Law No. 2015-08) or the Children’s Act/Code.
