Drawing on the observation of a growing concern in Switzerland for the expansion of the list of ‹protected› groups under the criminal provision on hate crimes, this paper aims to answer the question of which criteria should guide the selection of identity characteristics in law. To this end, it provides a critical synthesis of the different criteria debated in hate crime studies, discussing the existing literature, and ultimately outlining a proposition.
