Addressing child and adolescent’s mental health: the imperative of international Child’s Rights frameworks and State obligations

Abstract

This Master thesis examines the impact of state policies on child and adolescent mental health (CAMH) outcomes, focusing on the role of national strategies and the influence of UN Conventions, specifically the CRC and CRPD. Despite representing 44% of the global population and facing a significant prevalence of early-onset mental health conditions, many countries still lack comprehensive CAMH strategies. As of 2017, only 46% of countries had such strategies in place. The research explores how state legislation and policies in Colombia and Sweden, two countries with different economic and socio-political contexts, affect CAMH services. It assesses the role of state interventions in protecting rights, ensuring cultural sensitivity, and promoting community-led initiatives.

Using a scoping review of academic literature, UN reports, and policy documents, the study analyses how effectively state policies address CAMH needs and identifies barriers to access and quality. Findings reveal that while there is a global consensus on integrating mental health into all policy areas, significant gaps remain in human rights compliance. Issues include inadequate CAMH facilities, over-medicalization, and limited resources, particularly in low- and middle-income countries. Colombia and Sweden face distinct challenges related to policy implementation, cultural sensitivity, and resource allocation. The research concludes that recognizing mental health as a fundamental human right, rather than a mere healthcare component, is crucial for ensuring equitable access and effective CAMH services. Emphasizing early interventions, community-based care, and adherence to international human rights standards is essential for advancing MH outcomes and addressing existing disparities.
