Abstract

The proposal to suspend the protection of intellectual property rights (known as the «IP waiver»)currently under discussion at the World Trade Organization (WTO) for “the prevention, treatment or containment of Covid-19” includes in particular the suspension of the legal protection of trade secrets (i.e. “undisclosed information” pursuant to the terminology of Art. 39 TRIPS). This is of great practical importance since the manufacture of Covid-19 vaccines is complex and relies on trade secrets. This article presents selected thoughts on the implementation of such a suspension of trade secret protection, in particular about the creation of a mechanism providing for the non-voluntary transfer of trade secrets (compulsory licensing), which would be very tricky and raises many questions.
