Diplôme Master International Labour Standards and International Investment Law eng 2018 author Soorbekova Asel 699922 director Mbengue Makane Moïse 517132 24 April 2013, Dhaka, Bangladesh. 1,137 workers dead and around 2,500 people injured after the collapse of the Rana Plaza, making it so far the deadliest garment factory accident of all times. “Man-made events” like the Rana Plaza disaster and FDI-generated fragile labour regimes with devastating and unrepairable effects on workers' health and lives, hand-in-hand with environmental damages and violations of human rights, have led to questioning the legitimacy of existing international investment agreements.Hence, it is thanks to the emergence of the sustainable development and rights of States in International Law to regulate for the purposes of establishing their public interests that the modern International Investment Law has been undergoing many changes and is distancing itself from the classical school of International Investment Law. As a result, a new generation of IIAs has surfaced, containing labour protection provisions, let alone entire sustainable development chapters. Nonetheless, even newly concluded IIAs are mainly targeted at fostering economic growth and continue to provide for a strong investor protection with little to no mention of investor obligations or responsibilities with respect to labour rights.Having analysed several BITs and FTAs, concluded between 2012-2016, the outcome of this study will show that labour protection provisions of these treaties are either purely symbolic or that they are weak and largely focus on core labour standards. In light of this, this research will root for better labour protection provisions in future IIAs, stressing on the necessity to extend their coverage to a creation of favourable working conditions, particularly, occupational safety and health, as well as regulation of hours of work on 40 hours of a working week.
