Conférence Présentation / Intervention Bridging the Legal Gap: The Silence of CeDeFi in MiCA and Its Implications for EU Digital Sovereignty eng 2025-11-17 author Soltanzadeh Najmeh 418013 This paper investigates the regulatory silence of the Markets in Crypto-Assets Regulation (MiCA) concerning hybrid finance (CeDeFi) and its implications for the European Union’s digital sovereignty. Although MiCA provides the first comprehensive framework for crypto-assets, it leaves CeDeFi—systems merging decentralized execution with centralized oversight—outside its regulatory perimeter. This study applies a doctrinal and policyoriented methodology, interpreting MiCA’s legal provisions through functional analysis and comparative insights from Switzerland and Singapore. The findings reveal that MiCA forms a solid yet incomplete architecture: it establishes legal coherence but lacks interpretive tools for hybrid infrastructures and programmable compliance. This research argues that filling this silence through functional standards, SupTech-driven supervision, and adaptive legal interpretation would not only ensure regulatory consistency but also consolidate the EU’s normative power in governing algorithmic finance—turning digital sovereignty into a practical reality rather than an aspirational ideal.
